Terms of Service

1. Agreement to Terms

By accessing or using ReportKaart ("the Service"), operated by themindful.nl ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What ReportKaart does

ReportKaart uses AI to translate Dutch school report cards (rapporten) into English. You upload a photo or scan of the report, and our system extracts and translates the content. The translation is stored in your account and optionally saved to your Google Drive.

ReportKaart is an assistive tool, not a certified translation service. AI translations may contain errors. Do not rely on ReportKaart for official or legal purposes. Always verify important information with your child's school.

3. Eligibility

You must be at least 18 years old and a parent or legal guardian of the child whose report card you upload. By using the Service, you confirm that you have the right to upload and process the report card data.

4. Your account

You sign in using Google OAuth. You are responsible for maintaining the security of your Google account. We are not liable for unauthorised access to your ReportKaart data resulting from compromised Google credentials.

5. Acceptable use

You agree not to:

• Upload content that is not a school report card (e.g., identity documents, medical records)
• Use automated scripts or bots to access the Service
• Attempt to bypass rate limits or security measures
• Upload report cards for children who are not in your legal care
• Use the Service for any unlawful purpose

6. AI accuracy disclaimer

ReportKaart uses third-party AI models to perform OCR (optical character recognition) and translation. While we strive for accuracy:

• AI-generated translations may contain errors, omissions, or misinterpretations
• Star ratings extracted from report cards may occasionally be read incorrectly
• The chat feature provides AI-generated insights, not professional educational advice

We provide the Service "as is" without warranty of accuracy. Always refer to the original Dutch report card and consult your child's teacher for definitive information.

7. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including your child's report card information.

8. Google Drive integration

ReportKaart requests the drive.file scope, which limits our access to only files and folders created by ReportKaart. We cannot read, modify, or delete any other files in your Google Drive.

9. Service availability

We do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, AI provider outages, or capacity limits. We are not liable for any losses resulting from downtime.

10. Limitation of liability

To the maximum extent permitted by Dutch law, themindful.nl shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us (which, for the free tier, is zero).

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, you may request deletion of your data per our Privacy Policy.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
